The terms and conditions on this page set out the general conditions for your use of electronic systems and content under the domain name www.ethis.co.id (“electronic systems”). Read these terms and conditions carefully before using the electronic system or any services provided in the electronic system.

Make sure that you fully understand the terms and conditions. By accessing an electronic system, you accept and agree to be bound by these terms and conditions. If you do not agree with the terms and conditions stated here, please do not use this electronic system. If you continue to use this electronic system, then you are deemed to have accepted and agreed to the terms and conditions.

Definition

1. ETHIS / We are PT. ETHIS Fintek Indonesia, a Sharia-based Information Technology-Based Co-Financing Service Company that complies and complies with POJK No. 10 of 2022.

2. Service is a form of service or product that we provide in digital or physical form on the platform, to bring together financiers and fellow financing recipients in order to carry out Islamic Peer-to-Peer funding.

3. Platform is technology; electronic system; website and/or mobile application provided by ETHIS to users to be able to visit and access services.

4. User / you are any person who visits, accesses and/or uses the platform.

5. A financier is a user who uses the service who intends to provide funding through the platform.

6. Fellow Recipients of Financing are service users who intend to offer, upload, and publish business objects for joint funding by financiers through the Platform.

7. Campaign / project is a web page containing information related to funding projects submitted by fellow financing recipients.

Information

We state that the information we receive will be used to ensure the validity of the data. ETHIS and its associates, directors, employees and partners do not guarantee the content and accept no responsibility for any damages incurred for the use of the required documents. With the receipt of the information.

However, we implement internal due diligence checks to ensure that project or campaign information is available prior to publishing it on our site. If the information provided to the project or campaign owner is found to be untrue, inaccurate, incomplete or not updated, we reserve the right to suspend or terminate the project or campaign owner's account and prohibit all access to the electronic system.

Account Details

To use the electronic system service, you must first be registered as a member of the ethis.co.id electronic system so that you can access the registration page by clicking join. You will be redirected to a registration page which requires you to fill in details as a user, such as your username and password. It is your responsibility to keep your password confidential. You need to verify your email via an email sent by the ETHIS Indonesia admin. You are responsible for all activity that occurs on your account. If there is any suspicious transaction or activity on your account, you are advised to notify us immediately. We will take such action as we deem appropriate upon your notification of misuse of your account or any action that interferes with electronic systems.

User Criteria

Each user who registers as a financier must be over 17 years old and to become a financing recipient must be 21 years old and above, with details:

• Have a valid identity card;

• NPWP owned by yourself / owned by parents / owned by a valid husband / wife;

• Have a valid contact number;

• Have a bank account;

• Is a business entity legalized by the local government;

• Complete a declaration form for registration as a financier.

Copyright and Trademark

We respect the rights of every individual in terms of intellectual property. Therefore, we will respond to notices regarding copyright infringement in accordance with applicable law. As mentioned above, we do not allow anyone to take advantage of someone's intellectual property rights. In this case, you are not allowed to create, modify, copy, distribute, and upload information available in the electronic system. The information here is based on policies (risk mitigation, disclosure statement, terms and conditions, privacy policy, etc.) Any consents that we give and relate to the content listed in the electronic system can be deleted at any time without prior notice.

Restrictions on Use

By reading these terms and conditions, you agree that it is not allowed in any way to use the electronic system for the following purposes:

• Violate any other terms and conditions, policies or agreements contained in our electronic system;

• Performing fraudulent, criminal or unlawful acts in electronic systems;

• Misuse of electronic systems containing pornographic content, vandalism, vulgarity, sarcasm, racism, bullying, discrimination, hoaxes, terror, slander, hate speech, and politics;

• Violate applicable laws and regulations in the jurisdiction, including those written in the regulations of the Republic of Indonesia;

• Impersonate or deface the image of any person or entity;

• Violate copyright or proprietary rights;

• Share, or disclose any personal information from third parties; or

• Restrict others from using public forums on electronic systems.

We reserve the right to suspend and/or terminate your account if we believe that you have committed a violation or are suspected of committing a violation as stated above.

Use of Electronic Systems Services

Access and use of our services is your responsibility. ETHIS makes no representations or warranties of any kind, in writing or not. We do not have any responsibility related to your use or inability to use or delay the use of the electronic system, whether any information or material contained in the electronic system can be accessed, which is an action taken personally.

Compensation

You agree to indemnify and protect us from all claims, damages, claims, actions, costs and expenses in connection with any claims from third parties arising from or your use of electronic systems or other materials through electronic systems by you or your account users, which violates the terms and conditions of applicable law.

Confidentiality Obligation

Account users are allowed to access information on the electronic system for their personal use or for their business purposes, for the purpose of assessing whether or not they are entitled to participate in campaign financing or seek Sharia Financing. Each member accepts that he or she has a duty of confidentiality to the company with respect to:

• Internal operating systems and procedures used by the company;

• Provided agreements and documents; and

• Any information provided relates to the current potential financier.

Conflict of Interest

ETHIS officers are prohibited from providing financial assistance to financiers to finance projects. We will not provide any funding or funding for any project launched on the platform. We will adopt a conflict-of-interest framework that will have proper processes and procedures in place that will allow ETHIS to be allowed to financing on project campaigns.

Membership Cancellation

Any user may terminate his/her membership by sending a written notice of his/her decision to the company. The company will terminate its membership at any time for any reason by sending a written notice of termination to users of the electronic system.
